Terms of Use

Last updated 14 September 2026

These terms are the agreement between you and Raphael Yazdi, who operates Whipup. Using the app means you accept them. If you do not, do not use the app.

The part that matters most. Whips are written by a language model from a sentence somebody typed, and nobody reads them before they appear. There is no tolerance for content that sexualises anyone, harasses a real person, or is built to frighten or mislead — and no tolerance for people who post it.

1. Who may use Whipup

You must be at least 13 years old, and old enough where you live to agree to a contract on your own. There is no sign-in, so your access is tied to your device rather than to an account you can recover.

2. What you may make

Do not ask Whipup for, and do not publish, anything that:

The same rules apply to comments.

3. Reporting, and what we do about it

Every whip and every comment carries a menu with Report. A report reaches us, and we aim to review it within 24 hours. We may remove any whip or comment, and suspend or permanently block the person who made it, at our discretion and without notice. We do this to keep the feed usable, not as a punishment, and we are not obliged to explain any individual decision.

The menu also carries Block and Hide. Those act only on your own phone and take effect immediately.

If you think something infringes your copyright, write to raphael.yazdi@gmail.com with a link, a description of the work, and a statement that you own it or act for the owner.

4. What you own, and what you let us do

You keep every right you have in what you make. Because Whipup exists to show it to other people, you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and publicly show your whips, your captions and your comments — inside the app, on a share page, and in material promoting Whipup. That licence lasts as long as your content is on Whipup and ends when you delete it, except for copies already made by other people and for backups that have not yet aged out.

You confirm you have the right to give us that licence for everything you publish, including any photo or recording you attach.

5. What a model writes

Whips are generated. They can be wrong, strange, or simply not what the sentence asked for, and the same sentence twice will give two different things. We do not review a whip before it appears, and we make no promise about what any whip contains or does.

Whether a generated work can be owned by anyone, and by whom, is unsettled in most countries. We claim no ownership of what the model writes for you, and we do not promise that you own it either.

6. Using the service

Generation costs us real money on every request, so it is rate-limited and capped per day. Do not automate the app, script it, resell access to it, or try to raise those limits by any means other than asking us.

We may change the app, add limits, or stop the service. If we discontinue Whipup we will give notice in the app first where we reasonably can.

7. Ads

Whipup is free and carries ads. Every few whips the feed shows one ad page. Swipe past it like any other page. Ads pay for the generation described above, and they are the only money in the app: there is no purchase, no subscription and no paid tier.

The ads come from Google AdMob. We do not choose which ad you see, we do not endorse it, and we are not responsible for what an advertiser claims or sells. Anything you do with an advertiser is between you and them. What an ad request sends, and what iOS asks you about the advertising identifier, is set out in the Privacy Policy.

Do not tap your own ads to raise our revenue, and do not script or automate taps on them. Google treats that as invalid traffic, and we will block a device that does it.

8. Ending it

You may leave at any time with Settings → Delete everything & start over, which removes your content from our servers permanently. We may end your access if you break these terms.

9. No warranty

Whipup is provided as it is, with no warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise it will be available, correct, or free of faults.

10. Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost data or lost profits, arising out of your use of Whipup. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Where liability cannot be excluded, it is limited to €50.

Nothing in these terms affects the statutory rights you have as a consumer.

11. The App Store

Apple is not a party to this agreement and has no obligation to support Whipup. If the app fails to conform to any warranty Apple cannot disclaim, you may tell Apple and Apple will refund the purchase price — which for Whipup is nothing. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Governing law

These terms are governed by French law. Any dispute goes to the courts of France, unless you are a consumer elsewhere in the EU, in which case you may also bring it in your own country's courts and keep the protection of your own country's mandatory law.

13. Changes

If we change these terms in a way that matters, we will say so in the app before the change takes effect.
